JUST-IN: Supreme Court reinstates Sen. Samuel Anyanwu as PDP National Secretary

The Supreme Court has overturned the decisions of the Court of Appeal and the Federal High Court, which had previously removed Senator Samuel Anyanwu as the National Secretary of the Peoples Democratic Party (PDP).

Delivering the lead judgment on Friday, Justice Jamilu Tukur ruled that the matter of who holds the position of PDP National Secretary falls under the internal affairs of the party and is not subject to judicial intervention.

The apex court nullified the October 2023 judgment of the trial court and set aside the majority ruling of the Court of Appeal, which had upheld Anyanwu’s removal in December. Instead, it affirmed the dissenting judgment of Justice Ekanem, who had declared the lower court’s ruling invalid due to lack of jurisdiction.

Furthermore, the court held that the plaintiff, Aniagu Emmanuel, had no legal standing to challenge Anyanwu’s position, as he failed to demonstrate how the appointment personally affected him.
